Patent Trial and Appeal Board
(PTAB) matters

We represent inventors and companies before the Patent Trial and Appeal Board, from appealing an examiner’s rejection to challenging or defending an issued patent. Our engineering background helps us work through the technical issues in your case alongside the legal ones.

About our PTAB matters

Patent appeals and post-grant proceedings

The Patent Trial and Appeal Board (PTAB) is the body within the USPTO that hears appeals from patent examiners’ decisions and conducts trials on whether issued patents should stand.

Our firm can represent patent applicants, patent owners and petitioners in PTAB matters, including:

  • Ex parte appeals of final rejections
  • Inter partes review (IPR) petitions and patent owner responses
  • Post-grant review (PGR) proceedings
  • Defending issued patents against challenges
  • Evaluating PTAB options alongside litigation or licensing strategy

PTAB matters often turn on technical detail: how prior art is read, and what a claim actually covers. Herbert T. Patty’s background in mechanical engineering and process engineering at Intel, along with years of patent prosecution and licensing work, shapes how we build these arguments.

PTAB proceedings run on strict deadlines. If you’ve received a final rejection or your patent is being challenged, schedule a consultation to discuss your options.

A PTAB trial in which anyone other than the patent owner can challenge an issued patent’s validity based on earlier patents and printed publications. A petition can generally be filed nine months or more after the patent is granted.

A PGR must be filed within nine months of the patent’s grant, but it can challenge validity on almost any ground, not only earlier patents and publications.

Yes. An ex parte appeal asks the PTAB to review the rejection. The notice of appeal must be filed within the time allowed to respond to the rejection, so act quickly once you receive it.

Once the Board decides to hear a case, a final decision is generally due within one year. That’s often faster than patent litigation in court.
